Welcome to The SPARK Initiative. By accessing our website, purchasing products or services, or using any SPARK materials, you agree to the following Terms of Service. Please read them carefully before proceeding.

1. Acceptance of Terms

By using our website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please do not use our website or purchase our products or services.

2. Purchase Policies

All purchases made through The SPARK Initiative, including training registrations, event tickets, Curriculum Kits, Lesson Supplies, and licenses are governed by the following policies:

  • Training & Event Registrations: All sales are final. Registrations may be transferred to another individual, provided the transfer request is submitted at least 7 days prior to the event. In the event SPARK cancels an event, a full refund will be issued to the original payment method.

  • Curriculum Kits & Lesson Supplies: All sales are final and non-refundable once shipped to a verified license holder. Orders placed without a valid license on file will be automatically refunded and not fulfilled. Damaged or incorrect orders will be corrected through replacement at SPARK's discretion. Refunds are not issued for damaged or incorrect orders.

  • Licenses: All license sales are final and non-transferable. Licenses are subject to annual renewal. Use of SPARK materials beyond the license term without renewal constitutes unauthorized use.

3. License Agreement

SPARK offers two license types: Individual and Organization by Site. All licenses are non-transferable, non-shareable, and limited to the scope defined at the time of purchase. Licenses do not convey ownership of any SPARK materials, curriculum, or intellectual property. Unauthorized use, reproduction, or distribution of licensed materials is strictly prohibited.

4. Intellectual Property

All content, curriculum, programming, materials, branding, and resources created by or associated with The SPARK Initiative are the exclusive intellectual property of SPARK and are protected by applicable copyright and trademark law. This includes, but is not limited to, written materials, training content, program frameworks, logos, and the SPARK name and brand.

No content may be reproduced, distributed, resold, modified, or used outside of its intended licensed purpose without prior written permission from The SPARK Initiative. Unauthorized use of SPARK intellectual property may result in termination of your license and legal action.

5. User Conduct & Acceptable Use

By purchasing or using SPARK products, services, or materials, you agree to the following:

  • You will not resell, redistribute, or share SPARK materials with unlicensed individuals or organizations.

  • You will not reproduce or repurpose SPARK content for commercial or personal gain outside of your license scope.

  • You will not use SPARK's name, logo, or brand in any form without prior written authorization.

  • You will not misrepresent your affiliation with or endorsement by The SPARK Initiative.

  • You will use all SPARK materials in alignment with their intended educational and developmental purpose.

Violation of these terms may result in immediate license termination without refund and, where applicable, legal action.

6. Minors

SPARK's programs and materials are designed for educational and developmental use, including with youth populations. It is the responsibility of the purchasing organization or licensed individual to ensure that all applicable parental consent, data privacy, and child protection requirements are met in their jurisdiction when delivering SPARK programming to minors. SPARK does not knowingly collect personal information directly from minors through its website or store.

7. Limitation of Liability

The SPARK Initiative is not liable for any indirect, incidental, or consequential damages arising from the use of our products, services, or materials. SPARK's total liability, in any circumstance, shall not exceed the amount paid by the customer for the applicable product or service. All products and services are provided as-is, and SPARK makes no guarantees beyond what is explicitly stated.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in the State of Florida.

9. Changes to These Terms

The SPARK Initiative reserves the right to update or modify these Terms of Service at any time. Changes will be posted on our website with an updated effective date. Continued use of our website or services following any changes constitutes acceptance of the revised terms.
